By accessing or using Zebra ("Service," "Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

By using Zebra, you represent that:

• You are at least 16 years old
• You have the authority to enter into these Terms
• You will comply with these Terms and all applicable laws

What Zebra Is

Zebra is an AI-powered employee performance management platform that helps managers:

• Conduct more effective 1:1 meetings with intelligent agendas
• Track action items and commitments across conversations
• Generate personalized performance reviews
• Predict and prevent employee turnover through early warning systems
• Collect and analyze 360° feedback

What Zebra Is Not

Zebra is not:

• A replacement for professional HR advice or legal counsel
• A guarantee of employee retention or performance improvement
• A surveillance or monitoring tool
• A decision-making system (AI provides insights, you make decisions)

Subscription & Payment

Pricing

Current Pricing Model:

• Base fee: $25 per manager/month
• Per-report fee: $5 per direct report/month
• Annual billing: 10% discount when paid annually

Pricing Examples:

• 3 direct reports: $40/month
• 10 direct reports: $75/month
• 20 direct reports: $125/month

Money-Back Guarantee

Payment Terms

Billing:

• Charged monthly on your signup date (or annually if chosen)
• Automatic renewal unless cancelled
• Processed securely through Stripe

Proration:

• Adding team members mid-cycle: Prorated charge
• Removing team members: Prorated credit for next billing cycle

Cancellation & Refunds

How to Cancel:

• Self-service: Settings → Account → Cancel Subscription
• Email: support@usezebra.today with "Cancel Account" in subject
• Effective at end of current billing period
• No partial refunds for unused time (except 30-day guarantee)

Acceptable Use

You May

• Use Zebra for lawful business purposes
• Invite team members to collaborate
• Export your data at any time
• Provide feedback and feature requests

You May Not

Data & Privacy

Your Data Ownership

You Own Your Data:

• All data you input (meeting notes, reviews, team info)
• Your intellectual property remains yours
• You can export or delete your data anytime

We Own:

• The Zebra platform and software
• Our AI models and algorithms
• Aggregate, anonymized insights

How We Use Your Data

Permitted Uses:

• Provide and improve the Service
• Generate AI-powered insights for you
• Aggregate anonymized analytics
• Comply with legal obligations

Prohibited Uses:

• Selling your data to third parties
• Using your data for advertising
• Training public AI models with your data
• Sharing individual employee data externally

We Are Not Liable For:

Zebra is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, including merchantability, fitness for a particular purpose, accuracy, reliability, or availability.

Not Professional Advice

Zebra Does Not Provide:

• Legal advice
• HR consulting services
• Medical or mental health advice
• Financial advice
• Employment law guidance

Limitation of Liability

To the maximum extent permitted by law, we are not liable for:

• Indirect, incidental, or consequential damages
• Lost profits, data, or business opportunities
• Damages exceeding fees paid in past 12 months
• Third-party claims or actions

Examples (Not Liable):

• Employee turnover despite using Zebra
• Poor hiring/firing decisions based on Zebra data
• Legal disputes arising from performance reviews
• AI predictions that don't materialize

Termination

We May Terminate Your Account If:

• You violate these Terms
• You engage in prohibited activities
• Your payment fails (after grace period)
• You misuse the Service
• Required by law

Effect of Termination

• Access to Service ends immediately
• Data retained for 30 days (for export)
• Permanent deletion after 30 days
• Outstanding fees remain due

Changes to Terms

For Material Changes:

• Email notification to all users
• Prominent in-app notice
• 30 days before changes take effect
• Opportunity to cancel before changes

Your Options:

• Accept changes by continuing to use Service
• Cancel account before changes take effect
